We at Empower are committed to protecting your privacy. Empower has adopted data protection policies with respect to your privacy and security. This privacy and security policy statement concerns how Empower collects and uses your personal information in the framework of the Empower Plastic Positive website and related services.

About Empower and The Plastic Positive Subscription

Empower is a Norwegian firm which is building a global plastic waste ecosystem to tackle the global plastic waste crisis. By giving plastic waste a value we can both stop leakage of plastic into the environment and cost-efficiently incentivise collection of leaked waste. By tracking it and making digital inventories we also ensure that the most of it is reused and recycled. We provide digital tools to increase transparency, market access and low-cost operations.

The Empower Plastic Positive subscription is a programme to fund clean-ups and collection of plastic waste anywhere in the world. By matching those who can fund clean-ups and those who can actually clean up, we clean up the world while providing livelihoods to the ones at the bottom of the value chain. Collection organisations also have access to alternative funding to fund their collections and recycling activities.

This Privacy Policy is applicable to the Empower Plastic Positive website and related services.

Responsibility for processing

Empower’s Chief Technical Officer Gjermund Bjaanes has the formal responsibility for the processing of your personal information.

Purpose of processing

We will use information about you for any of the following purposes:

• registering you as a user and create your user account;
• verifying your identity;
• processing payments if you have submitted your payment details when subscribing;
• sending you necessary information or important updates related to your Plastic Positive activities (for example, related to payments or expiration of your subscription);
• providing customer service or support;
• sending you related news or updates from Empower.

Which data are processed?

In order to become a Plastic Positive subscriber, you are required to provide:

As an individual subscriber:
• first and last name;
• country;
• email address;
• payment card details (card number, date, and code).

As a corporate subscriber:
• company name;
• name of authorized representative;
• company address;
• invoicing details (bank account number, address);
in order to proceed.

Your Plastic Positive subscription will help fund clean-ups and collection activities of plastic waste through our local partner organisations.

We process both personally identifiable information and non-personally identifiable information about you. Personally identifiable information is information that identifies you as an individual. Non-personally identifiable information is information and any other details that do not reveal your personal identity.

Personal information about minors

Empower does not gather information about your age and does not purposely process information about children under 15 years of age.

Legal basis for processing of information

The legal basis for the processing of personal information is the consent that you have voluntarily given us when registering to subscribe to be Plastic Positive.

It is voluntary to provide personal information in order to subscribe to and enjoy the benefits of the Plastic Positive programme through Empower. Unless otherwise specified, your consent or agreement to such processing is considered given when you provide the information.

You can withdraw and manage your consent at any time by contacting us. See contact information in the introduction to this declaration.

The processing of the data is also necessary to take steps at your request for the performance of the services (matching your donation to our collection partners, providing you updates of clean-ups and impact).

Access to the information

To ensure that the processing of information is carried out in a safe manner, only specifically authorized persons at Empower will have access to the information you provide us. The number of employees with such approval is limited. Access to information is secured by access mechanisms.

We use data processors to assist us with various processes and services. We transfer your data with third-party service providers (including contractors and designated agents). All our third-party service providers are required to take appropriate security measures to protect your personal information and are not allowed to process your personal information for their own purposes, unless we have signed an agreement where the providers acting as data controllers commit an adequate level of data protection.

Data processors and transfer of data to other countries

Empower is using data centers located in Europe for data storage and cloud processing.

We reserve the right to transmit information from the location where you have registered your e-mail address to our servers in Norway and the above-mentioned data centers.

If information is transferred within the EU/EEA, we will ensure that the data protection rules set out in the GDPR are followed. If we pass personal information to third parties located outside the EEA, we will ensure that the transfer is lawful in accordance with GDPR Chapter V. Appropriate measures include the use of EU Standard Contractual Clauses.

Safeguarding of the information

We have established rules and procedures for the protection of personal data and privacy.

When we treat "non personally identifiable information" combined with "personally identifiable information" (for example your name combined with geographical location) the collected information is treated as personally identifiable information.

We shall use all reasonable precautions to ensure that our employees who have access to information about you have adequate information to ensure that they treat such information in accordance with this statement and our obligations under privacy legislation.

Your rights

You have the right to know how your personal information is processed by an enterprise, under the General Data Protection Regulation (GDPR), article 13. Empower has given this information in this statement.

You are entitled to access your own information. If personal information is inaccurate, incomplete or inaccessible, you can ask Empower to correct the information. See contact information in the introduction to this declaration.

We do not process and store information about you for longer than necessary for the intended purpose, or as required under existing agreements, and not beyond legal limits. We delete personal information when a user gives notice that he/she no longer wishes to use the service. For example, your email address used to send out updates from us is deleted when you unsubscribe. The same is done when we are notified of inactive email addresses.

Enforcement of this privacy policy statement

Empower may use the information that we collect about you when we have reason to believe that it is necessary to identify, contact or bring legal action against persons or entities that may harm you, us or others. We may also disclose your information when we believe it is required by law.

Consent, governing law, venue

This privacy statement applies to all users of the Empower Plastic Positive website and related services. We require that users agree to comply with the declaration as part of our relationship.

By registering and by using the Empower Plastic Positive website and related services, you accept that your personal data may be processed in accordance with this privacy policy.

Empower operates from Norway and is subject to Norwegian law. This declaration also meets the minimum requirements imposed by GDPR. You agree that any disputes will be handled by the court in Oslo, in accordance with the laws of Norway, unless otherwise dictated by mandatory local law.

Empower reserves the right to change or update the privacy statement. All changes are valid from the time of being posted, and will include information gathered from that date, as well as existing information held by Empower.
